Pioneer-net's Customer Policies & Agreement

As of 6/30/98,Revised 7/1/2002. We require all of our customers to carefully read this document: Pioneer-net.com reserves the right to change this agreement at any time. By using any of Pioneer-net.com services, the Customer agrees that he or she has read and understands these terms and conditions and agrees to be bound by them.

1.0 BILLING & USAGE

1.1 In consideration of services rendered and to be rendered, the Customer guarantees the payment of all charges incurred by the Customer(s) for services provided by Pioneer-net.com.

1.2 Customer understands accounts for internet services are PREPAID IN ADVANCE on a monthly, quarterly, or annual basis. Cancellation of services before the prepaid term of service has ended does not entitle the customer to a refund of all or part of the prepaid fee. Pioneer-net has a NO REFUND policy to prevent customers from moving around locally from 1 Internet Provider to another just to follow Specials, Freebies, etc..

1.3 Revison Due to the Thousands of dollars lost over the years due to customers not notifying us of cancellation and using their account to check their mail until we cut the account, we are forced to implement a First and Last Policy. Which means when your next billing cycle comes around 1 month will be set aside for your last month so your billing will come due next time in 2 months instead of 3 months or 11 months instead 12 in the case of the Annual accounts. Then everything goes back to normal. If you move out of the area, you will be refunded the unused portion. Always seems to be the case a few have to spoil it for the majority of people who pay on time. So in appreciation for those who pay on time, we are going to discount your bill $5.00 on a quarterly or $10.00 on the yearly Accounts..

REFUND EXCEPTIONS... If Customer is moving out of the Local Calling area a prorated refund check may be mailed to their new Address.

1.4 In case of errors or questions about a bill, the Customer is to refer queries as soon as possible to our office (863-3783) in Myrtle Creek, Oregon. The Customer must respond no later than 30 days from the billing date of the first bill on which the problem or error appeared. After this time, Pioneer-net.com will consider the bill to be correct.

1.5 If the account becomes delinquent and it becomes necessary to forward this account to an attorney/collection agency for collection, the Customer agrees to pay an attorney's/collection agency fee for the handling of same at a fixed rate of 25% of the amount due with a minimum of $75 (Seventy-five Dollars) plus all other costs for collection including court costs.

1.6 Customer agrees to use Pioneer-net.com systems in accordance with the Service Plan purchased. Time limits, number of concurrent connection sessions, bandwidth limitations, and/or other limitations on service as stated within that Service Plan and this document are the defined limitations which the customer must adhere to. Customer usage of Pioneer-net.com systems beyond these limitations may be billed to the customer at the closest applicable rate within the service plan or this document, at the discretion of Pioneer-net.com.

1.7 Pioneer-net.com provides their accounts with "Unlimited NORMAL USAGE ". Unlimited normal usage MEANS ACTIVE USAGE "NOT COASTING OTHERWISE, DIALED FOR HOURS AND HOURS JUST TO CHECK MAIL EVERY 10 OR 15 MIN". IT IS NOT NECESSARY BE LOGGED IN ALL DAY AND NIGHT TO CHECK MAIL, BECAUSE PIONEER'S POST OFFICE HOLDS THE MAIL FOR YOU UNTIL YOU ARE READY TO PICK IT UP. Customer agrees to keep the connection active only when actively using it, and not to use any automatic or electronic method to avoid disconnects from SERVER for inactivity..

1.8 Past receipt of services overlooked in billing does not constitute an understanding that Pioneer-net.com shall not have the ability to bill and collect payment for such services overlooked by our Billing Dept.

1.9 Should any violations within these Terms of Service require corrective action on the part of Pioneer-net.com, the Customer will be held liable for all costs associated with such action.

2.0 TERMINATION OF SERVICE

2.1 Pioneer-net.com reserves the right to terminate all services to any customer with single or multiple accounts should any such account become delinquent and are not paid within 10 days of any billing due date. Multiple accounts include but are not limited to parent account; individuals and sole proprietorships; and any other entities to which there is any direct or indirect connection between the accounts.

2.2 Customer understands that Pioneer-net.com reserves the right to terminate any account for any reason and at any time. Customer may, at Pioneer-net.com discretion, receive a refund for prepaid but unused services.

3.0 CANCELLATION/SUSPENSION OF SERVICE

3.1 The Customer additionally agrees to provide Pioneer-net.com with WRITTEN NOTICE of cancellation to 267 Ash Cr Rd, Riddle Or 97469.

3.2 Customer understands that nonpayment of charges SHALL NOT constitute a formal termination of service with Pioneer-net.com. The account is considered active, for both use and billing purposes, until such time as Pioneer-net.com receives written notification that the customer wishes the account terminated.

3.3 Should the customer wish a suspension of services and billing for some period of time, the primary accountholder should promptly contact our office to arrange this.

4.0 TECHNICAL SUPPORT SERVICES

Platforms

4.1 Pioneer-net.com shall upon request, advise the customer as to what hardware and software platforms for which Pioneer-net.com will generally provide technical support. At this time , Pioneer-net.com generally supports internet access from systems running the  Windows95, Windows98 and MacOS (System 7.1 or greater) operating systems (OS's). Pioneer-net.com may elect, at its own discretion, to add to or subtract from this basic list. The customer is welcome to access the internet with whatever hardware/OS/software the he or she wishes to use, regardless of what Pioneer-net supports. However Pioneer-net is under no obligation to help such a customer obtain functionality from such non-supported systems.

4.2 It is the customer's responsibility to provide a correctly configured computing platform and associated hardware, with properly installed and maintained operating system software, on which internet software may be installed and used. Various combinations of operating system, application, and internet software will place resulting hardware demands upon the system; it is the customers responsibility to provide hardware which meets these demands.

SET UPS

4.3 At Pioneer-net.com setup is done by a setup disk, if assistance is needed during installation it is included free of charge, or if they bring the machine in to the Office to be set up by a technician.

4.4 Pioneer-net.com will make reasonable efforts to support its customers telephonically or via other electronic means such as email or web pages, in their efforts to connect with and use the internet via Pioneer-net.com systems. It's HIGHLY Recommended that your print out and keep our setting page to obtain information on our system settings, so you can restore those setting if necessary.

4.5 Pioneer-net.com will make all reasonable efforts to provide concise, accurate information via telephonic and electronic technical support, however such support is to be considered as advice only. The customer is responsible for the maintenance and keeping his system in good working order. Pioneer-net.com specifically disclaims any liability for damages resulting from the customer's use or misuse of advice given by any Pioneer-net.com employee or electronic communication, past, present, or future.

4.6 If the need is for 1 of Pioneer-net's Techs to fix the customers machine personally. Customer shall be required to sign a release form authorizing Pioneer-net.com to perform any hands-on maintenance or upgrades to customer computing equipment, prior to any such service being performed. Upon completion of such service by Pioneer-net.com staff, customer shall be required to sign a statement certifying that such work has been completed satisfactorily. These release forms may contain other conditions of service; customer signature indicates acceptance of such conditions.

4.7 The customer is strongly encouraged to contact Pioneer-net's technical support personnel when there is a perceived problem with his or her ability to connect to Pioneer-net.com systems, because of a set up error, or Pioneer-net's system not recieving calls properly. We can use this information to provide a better quality and support to its other customers. Pioneer-net.com makes all reasonable efforts to provide timely technical support to its customers, however makes no guarantees as to that timeliness. Pioneer-net.com specifically disclaims any liability resulting from the customer's ability or inability to receive technical support in a timely manner.

4.8 Certain technical support issues require the use of the customer's original installation media (disks, tapes, CD's, or other data containers) for operating system or other software. In no instance shall Pioneer-net.com provide such media; it is the customer's responsibility to produce such software if it is needed to perform some technical support service.

5.0 MISCELLANEOUS

5.1 By making use of an Pioneer-net.com account, the Customer certifies to Pioneer-net.com that he or she is eighteen (18) years of age or older. If the Customer allows an individual under eighteen years of age to access the Internet from Customer's Pioneer-net.com account, Customer takes full responsibility for the minor's access to any information that might be viewed as adult or unsuitable and agrees to hold harmless and indemnify Pioneer-net.com for any claims or charges that arise from said minor's use of service.

5.2 Customer acknowledges that the Internet contains some information that may be deemed offensive, obscene, or adult in nature. Customer accesses such information at his or her own risk, and understands that Pioneer-net.com has no way to limit access to this type of material located on the servers of other providers. Customer understands that Pioneer-net.com reserves the right to remove from its servers any material that Pioneer-net.com management deems to be objectionable. Portrayal of objectionable material on Pioneer-net.com servers may be grounds for termination of the user account, at the sole discretion of Pioneer-net.com staff.

5.3 The Customer agrees to take responsibility for any accesses, retrieval, and/or storage of any and all information available to Customer from his/her Pioneer-net.com account. The Customer indemnifies Pioneer-net.com against any and all claims or charges relating to the information Customer can or does access while using his/her Pioneer-net.com account.

5.4 Personal home page areas (defined as that web space which is included witin any or our personal level account packages) may not be used for commercial or organizational purposes. If the user wishes to advertise product(s) or service(s), business web space must be rented. Violations of this policy will result in the customer being charged for the advertising. Commercial and Organizational purposes are defined as being any type of advertising for profit. Non-profit organizations such as public schools, churches, etc. are not included in this definition.

5.5 Customer shall not intentionally allow unauthorized connections to Pioneer-net.com, unauthorized reselling of Pioneer-net.com services, or the solicitation of Pioneer-net.com users to become subscribers of other on-line information services or long-distance services, nor shall Customer in any way duplicate any Pioneer-net.com materials, advertising, brochures, pamphlets and the like or any other information which is proprietary to Pioneer-net.com.

5.6 Pioneer-net.com reserves the right to direct a customer to remove any program, process, or technique from a Web site that causes excessive utilization of Pioneer-net.com bandwidth or resources.

6.0 PASSWORDS

6.1 The Customer may be provided with or may select an identification code (username) and confidential password for customer's exclusive use. The customer account is intended to be used as defined in our chart of accounts. Customer agrees to pay and be responsible for, upon receipt of each monthly statement, all usage of this identification code. In locations where simultaneous login with the same username is allowed, Customer understands that there may be an additional charge for the duration of all concurrent sessions.

6.2 The Customer understands that, while Pioneer-net.com makes every effort to maintain the security of its machines and passwords, Pioneer-net.com is not liable if Customer's username, password, and/or data is compromised. Further, the Customer is expected to maintain a secure password consisting of no known word or phrase and using numbers, letters, and (optionally) certain special characters. Hence, the Customer may be held liable for any actions taken by an individual or group who have obtained/guessed the Customer's password and used it to access his account. Under no circumstances is Pioneer-net.com liable for the actions taken by a compromised account.

6.3 The Customer understands that Pioneer-net.com may not maintain a record of existing passwords. If the Customer forgets his/her password, the only recourse may be for Pioneer-net.com to issue a new password upon verification of the caller's identity.

7.0 ILLEGAL ACTIONS

7.1 Pioneer-net.com services and accounts may only be used for lawful purposes. Use of an Pioneer-net.com account or service in an illegal manner is grounds for immediate termination. Customer agrees to hold harmless and indemnify Pioneer-net.com against any claims or charges that arise from Customer's use of Pioneer-net.com services and/or accounts.

7.2 Use of an Pioneer-net.com account to gain passwords, encryption codes, or other security information of Pioneer-net.com or other sites on any computer network is grounds for immediate termination and, if illegal, will be reported to the proper authorities. Use of an Pioneer-net.com account or other resource to break into an Pioneer-net.com or other site's machine is also grounds for immediate termination and will be reported to the affected site and the proper authorities.

8.0 EMAIL

8.1 While Pioneer-net.com does not normally monitor the content of any Customer's e-mail, Usenet postings, downloads, etc., the Customer acknowledges that Pioneer-net.com has the right to monitor user activity if said activity is adversely impacting Pioneer-net.com services and/or another site, or if other situations arise in which such monitoring becomes necessary (at our discretion). Pioneer-net.com will not, however, disclose user activity to another site or entity unless required by court order, subpoena, or other legal force.

8.2 Pioneer-net.com reserves the right to move, delete, or reduce the Customer's mailbox if said mailbox has reached a size that is adversely affecting system performance. Further, Customer acknowledges that Pioneer-net.com has the right to kill any mail processes being run by the Customer that are adversely affecting system performance. In these and all instances of system performance being affected, Pioneer-net.com is the sole judge of what is adverse.

9.0 SECURITY

9.1 Information transmitted over the Internet and/or other computer networks is generally not considered to be secure. While Pioneer-net.com respects and makes all reasonable efforts to maintain the privacy of our customers, the Customer understands that there is no guaranteed privacy on the Internet and that Pioneer-net.com can not be liable or responsible for any viewing or interception of Customer's e-mail, downloads, news, etc., by other customers or individuals at Pioneer-net.com or on any network.

10.0 SERVICE QUALITY

10.1 Pioneer-net.com makes no warranty of its service and availability. While a good faith effort will be made to restrict any and all downtime to scheduled maintenance periods, no guarantees are made as to any account, product, or service offered by Pioneer-net.com. In addition, Pioneer-net.com makes no warranty of Customer transmissions, connections, downloads, etc. Customer is solely responsible for any losses, damages, or expenses related to service failure, whether caused by Pioneer-net.com or a Customer, and agrees that Pioneer-net.com shall not be liable for any or all of same.

10.2 The Customer agrees to indemnify and hold Pioneer-net.com wholly harmless from and against any and all liabilities that may arise as a result of the failure of services, equipment or software of Pioneer-net.com, with the exception of willful misconduct or omissions of Pioneer-net.com.

11.0 NETIQUETTE

11.1 Customer agrees to abide by the generally accepted rules of netiquette and the acceptable use policies of any networks or services accessed while using Pioneer-net.com. It is the responsibility of the Customer to familiarize himself/herself with these rules if he or she is not already cognizant of them. Violations of said rules and policies may be grounds for termination of Customer's account with Pioneer-net.com, with Customer agreeing to abide by Pioneer-net.com's interpretation of the above.

11.2 Netiquette violations that may result in the termination of Customer's account include, but are not limited to, the following:

  1. Using an Pioneer-net.com mail server to 'mail bomb' users/sites on the net. Mail bombing in this sense refers to sending very large and/or very many messages to a user or site, usually in the hopes of filling their disk space or quota and causing their mail server to crash or their mail to bounce.
  2. Sending unsolicited e-mail which provoke complaints from the recipient(s).
  3. Posting a single article or substantially similar articles to an excessive number of newsgroups (e.g., more than 10) which provoke complaints.
  4. Continued harassment of other users, whether Pioneer-net.com or not, after being asked to stop the correspondence by both the recipient and Pioneer-net.com.
  5. Sending mass e-mail (e.g., more than 20 recipients) that provokes complaints to Pioneer-net.com, or sending such mail of such a large volume or size that it adversely affects an Pioneer-net.com mail server.
  6. Posting and/or e-mailing pyramid schemes and/or chain letters to any newsgroup, mailing list, or individual.
  7. Making repeated off-topic posts that generate complaints to Pioneer-net.com. While Pioneer-net.com does not monitor the contents of its users' posts, it does expect the Customer to abide by the charter of each newsgroup or other message posting area and will respond to complaints of repeated charter violations.
  8. Engaging in any of the above from another provider and referencing an Pioneer-net.com mail account or WWW page in the message.
  9. Running unauthorized bots or other automated processes on any IRC server, whether said server is run by Pioneer-net.com or not.
  10. Harassing other IRC users, whether by kicking them off a channel, mass messaging, or other means.
  11. Impersonating another user and/or forging header information on e-mail or posts.
  12. Using a server of Pioneer-net.com or another site to exchange, store, and/or facilitate usage of pirated software or software designed to facilitate piracy.
  13. Using a server of Pioneer-net.com to distribute instructions on "hacking" into computer systems, creating viruses, or interfering with telephone services.

11.3 Pioneer-net.com is  strongly against the use of its systems to in any way propagate "SPAM" or "UCE (Unsolicited Commercial Email)". This is typically defined as a mass-mail as in 9.2e above, or as other public postings as in 9.2 c, f, g, k, or m above, or any combination of such means. Use of Pioneer-net.com systems to propagate such traffic shall be considered billable by v at the current US Mail First Class postage rates on a regular letter, per email, newsgroup posting, or other item sent. Such occurrences shall be reviewed by Pioneer-net.com management on a case-by-case basis, and the decision of Pioneer-net.com management shall be considered final and binding. The Customer or other user of systems is strongly advised to consult with Pioneer-net.com management before initiating any such communication or posting via the internet.
